TERMS AND CONDITIONS – EU CONSUMERS

These Terms apply to consumers residing within the European Union purchasing through our webshop.

By placing an order, you agree to these Terms.

Swedish law applies. Mandatory consumer protection laws in your country of residence remain unaffected.

2. Products

Millway AB sells high-performance motorsport and automotive components.

Unless explicitly stated otherwise, products are intended for motorsport and performance use. Certain products may not be approved for public road use in all jurisdictions. The customer is responsible for ensuring legal compliance in their country.

3. Prices and Currency

All prices are stated in SEK or EUR (as displayed) and include VAT where applicable for EU consumers.

Shipping costs are added at checkout.

4. Payment

We accept payment methods displayed at checkout.
Payment must be received before dispatch unless otherwise agreed.

5. Delivery

Delivery times are estimates and not guarantees.

Risk transfers to the consumer upon physical possession of the goods.

If delivery is delayed significantly, the consumer may have rights under applicable consumer legislation.

6. Right of Withdrawal (14 Days)

EU consumers have a 14-day right of withdrawal from the day of receiving the goods.

To exercise the right:

  • Notify us in writing within 14 days.
  • Return the product within 14 days of notification.

The consumer bears return shipping costs unless otherwise stated.

Refunds will be processed within 14 days after receiving returned goods.

The right of withdrawal does not apply to:

  • Custom-made products
  • Products modified to customer specifications
  • Used or installed products

7. Warranty and Claims

Consumers have statutory rights under EU consumer law.

If a product is defective:

  • Notify us within reasonable time.
  • Provide documentation/photos if requested.

We may:

  • Repair
  • Replace
  • Offer price reduction
  • Refund

This does not limit mandatory legal rights.

8. Limitation of Liability

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence
  • Fraud
  • Mandatory statutory rights

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential losses.
  • Liability is limited to the purchase price of the product.

Motorsport and performance parts may increase mechanical stress and risk. Installation should be performed by qualified professionals.

9. Product Use

The customer is responsible for:

  • Proper installation
  • Professional inspection
  • Compliance with vehicle regulations

Improper installation voids warranty.

10. Customs & Cross-Border Shipments

For deliveries outside Sweden but within the EU, VAT handling follows EU distance selling rules.

For deliveries outside the EU, the customer is responsible for import duties, customs clearance and local taxes.

11. Force Majeure

Millway AB is not liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, war, supply chain disruption, strikes, or governmental actions.

12. Severability

If any provision is held invalid, remaining provisions remain enforceable.

13. Governing Law and Disputes

Swedish law applies.

Disputes shall be settled by Swedish courts.
EU consumers may also have the right to bring proceedings in their country of residence under mandatory EU rules.
